Welcome to Digital Cemetery. These Terms and Conditions govern the use of our platform and services offered. By accessing or using our services, you agree to be bound by these terms.

2. Definitions

• "Platform" refers to the Digital Cemetery website and all associated services.
• "User" refers to any person who accesses or uses the Platform.
• "Memorial" refers to the commemorative page created for a person or animal.
• "Content" refers to all information, texts, photographs, and videos uploaded to the Platform.

3. Services Offered

Digital Cemetery offers the following services:

• Creation of permanent online memorials for deceased persons
• Creation of permanent online memorials for pets
• Generation of QR codes for memorials
• Ability for visitors to leave tributes and messages

4. Registration and Account

To create a memorial, you must register an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

5. Payments and Pricing

Memorials are available in two plans: Basic and Premium. Payment is one-time and the memorial remains active permanently after payment is made. Prices are displayed on the pricing page and may be changed without prior notice for new memorials.

All payments are processed through Revolut Business and are final. We do not offer refunds after memorial publication, except as required by law.

6. Content and Responsibility

You are responsible for the content you upload to the Platform. You agree to:

• Have the legal right to publish the information and photos uploaded
• Not upload illegal, defamatory, obscene content or content that violates others' rights
• Not use the Platform for spam or fraudulent activities
• Respect the dignity and memory of commemorated persons

7. Intellectual Property Rights

You retain all rights to the content you upload. By uploading content, you grant us a non-exclusive license to display this content on the Platform.

All design elements, logos, and source code of the Platform are the property of Digital Cemetery.

8. Privacy

The processing of your personal data is governed by our Privacy Policy. Please consult it for complete details.

9. Availability and Changes

We strive to maintain the Platform available 24/7, but we cannot guarantee uninterrupted availability. We reserve the right to modify, suspend, or discontinue services at any time.

10. Limitation of Liability

The Platform is provided "as is". We do not guarantee that services will be uninterrupted or error-free. In no event will we be liable for indirect, incidental, or consequential damages.

11. Memorial Deletion

Users may request deletion of memorials from their account. We reserve the right to delete memorials that violate these terms without prior notice.

12. Applicable Law

These terms are governed by the laws of Romania. Any dispute will be resolved by the competent courts of Romania.

13. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be published on this page. Continued use of the Platform after changes constitutes acceptance of the new terms.
